  1. ACCEPTANCE OF TERMS
    • By sharing content with Nevis Tourism Authority, whether through social media, our website www.nevisisland.com, marketing campaigns, emails, or any other digital channel, you agree to comply with these User-Generated Content Terms and Conditions (“Terms”). If you do not agree, please do not submit or share content with us. By responding “#YES,” you expressly acknowledge and agree to these Terms
  2. DEFINITION OF USER-GENERATED CONTENT (UGC)
    • “User-Generated Content” (UGC) includes, but is not limited to, photographs, videos, testimonials, reviews, comments, text, graphics, audio, location information, and any other material that you post or share with Nevis Tourism Authority via social media using specific mentions, hashtags, or tags, or by sending content directly to our team.
  3. LICENSE TO USE
    • By sharing UGC with Nevis Tourism Authority, you grant us and our affiliates, partners, subsidiaries, licensees, and authorized third parties a non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and worldwide license to use, modify, reproduce, distribute, create derivative works from, publicly display, and otherwise utilize such content in any media or platform, including but not limited to:
      • Website www.nevisisland.com
      • Official social media channels
      • Marketing and advertising campaigns
      • Promotional emails and newsletters
      • Printed or digital promotional materials
    • This license does not transfer ownership of your content but allows us to use it to promote Nevis Tourism Authority without any obligation of compensation. We may use, display, reproduce, and edit the content at our sole discretion without notice to you.
  4. REPRESENTATIONS AND WARRANTIES 
    • By submitting or sharing UGC, you represent and warrant that:
      • You own the copyright or have the necessary authorization to grant the license described in these Terms.
      • The content does not infringe on third-party rights, including copyright, trademarks, privacy, or publicity rights.
      • The content does not include offensive, discriminatory, defamatory, illegal, obscene, pornographic, abusive, or otherwise
        unlawful material.
      • You have obtained consent from any identifiable person featured in the content.
      • You are at least 18 years old or have parental/guardian consent if under 18.
  5. RIGHTS OF THE NEVIS TOURISM AUTHORITY
    • We reserve the right to:
      • Modify, adapt, or edit your UGC to fit our formats and needs.
      • Remove any content without prior notice if we deem it non-compliant with these Terms.
      • Request additional documentation to verify the authenticity of the content if necessary.
      • Use your name, username, image, likeness, or any other identifying information in connection with the use of your UGC.
  6. LIABILITY DISCLAIMER 
    • By sharing your UGC, you agree to indemnify and hold harmless Nevis Tourism Authority, its affiliates, partners, directors, employees, agents, licensees, and authorized third parties from any claims, damages, or liabilities arising from the use of your UGC under these Terms, including but not limited to copyright infringement, privacy violations, or defamation claims.
  7. COPYRIGHT POLICY
    • We respect intellectual property rights. If you believe your copyrighted work has been used in a way that constitutes infringement, you may submit a written notification to our designated agent. Your complaint should include: 
      • Your contact information
      • A description of the copyrighted work being infringed
      • The URL or location of the infringing material
      • A statement of good faith belief that the use is unauthorized
      • A declaration that the information provided is accurate under penalty of perjury
  8. LIMITATION OF LIABILITY 
    • IN NO EVENT SHALL NEVIS TOURISM AUTHORITY OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE UGC, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WE ASSUME NO RESPONSIBILITY FOR ERRORS, INACCURACIES, OR UNAUTHORIZED USE OF USER CONTENT.
  9. INDEMNITY 
    • You agree to defend, indemnify, and hold harmless Nevis Tourism Authority and its affiliates from any claims, expenses, or damages arising from your UGC, your violation of these Terms, or your breach of any representation or warranty stated herein.
  10. DATA PROTECTION AND PRIVACY 
    • Any personal information related to UGC will be handled in accordance with our Privacy Policy, available at www.nevisisland.com.
  11. CHANGES TO THE TERMS 
    • We reserve the right to modify these Terms at any time. Updates will be posted on our website and will take effect immediately upon posting.
